    smoke

    driving

    was
    observed
    that
    there
    were
    trucks
    from
    E.King
    Hauling
    in
    the
    process
    of
    receiving
    loads
    of
    what
    looked
    to
    be
    C&
    D
    debris.
    I
    then
    assessed
    the
    remainder
    of
    the
    site
    and
    observed
    broken
    concrete,
    scrap
    metal,
    compost
    material,
    property
    belonging
    to
    the
    City
    of
    Chicago
    (signs),
    railroad
    ties,
    two
    piles
    of
    wood,
    one
    in
    the
    rear
    (which
    was
    burning)
    and
    one
    in
    the
    front
    near
    the
    entrance
    that
    was
    in
    the
    process
    of
    segregation
    by
    an
    unknown
    person
    that
    looked
    to
    be
    an
    employee,
    port-a-johns
    with
    the
    advertisement
    of
    OUI!OUI!
    Incorporated
    and
    a
    water
    tanker
    with
    the
    name
    Speedy
    Gonzalez
    Inc.
    spray
    painted
    on
    the
    side.
    I
    then
    with
    the
    help
    of
    Inspector
    Collins
    proceeded
    to
    interview
    the
    heavy
    equipment
    operator
    (
    Front
    End
    Loader)
    about
    the
    generation
    point
    of
    the
    material
    and
    destination.
    The
    operator
    of
    the
    loader
    than
    stated
    that
    he
    had
    a
    manifest
    from
    the
    1EPA
    and
    that
    they
    were
    working
    for
    the
    City
    of
    Chicago
    and
    CTA.
    I
    then
    corrected
    the
    individual
    and
    stated
    that
    he
    is
    not
    working
    for
    the
    City
    of
    Chicago
    and
    that
    the
    manifest
    states
    a
    different
    address
    and
    that
    the
    generator
    was
    in
    fact
    CTA
    signed
    by
    Chuck
    Webber
    with
    no
    date.
    l
    then
    talked
    to
    Supervisor-Stanley
    Kaehler
    of
    DOE
    via
    Nextel
    and
    gave
    all
    information
    on
    the
    ongoing
    investigation.
    Supervisor
    Kaehler
    then
    stated
    that
    he
    would
    send
    another
    inspector
    to
    assist
    at
    the
    site,
    along
    with
    the
    Director
    of
    Inspections-
    John
    KryI.
    After
    contacting
    supervisor
    Kaehler,
    I
    proceeded
    to
    speak
    with
    the
    driver
    of
    the
    E.
    King
    truck
    and
    stated
    that
    he
    is
    not
    to
    remove
    the
    material
    from
    the
    site
    until
    further
    notice.
    The
    Driver
    and
    heavy
    equipment
    operator,
    than
    stated
    he
    would
    continue
    his
    work
    until
    the
    gentleman
    in
    the
    white
    pick
    up
    truck
    told
    them
    not
    to
    do
    so.
    I
    then
    spoke
    to
    the
    driver
    of
    the
    white
    Truck
    who
    was
    identified
    as
    the
    owner
    of
    Speedy
    Gonzalez
    Inc.
    and
    he
    stated
    that
    we
    were
    on
    private
    property
    and
    that
    we
    had
    no
    right
    to
    be
    on
    his
    property.
    I
    then
    asked
    Mr.
    Gonzalez
    to
    cease
    his
    illegal
    transfer
    station
    activities
    and
    he
    in
    turn
    stated
    the
    manifest
    in
    my
    hands
    were
    not
    given
    to
    me
    by
    the
    people
    on
    the
    site
    and
    he
    proceeded
    to
    drive
    off
    onto
    the
    other
    side
    of
    the
    property
    and
    let
    his
    employees
    continue
    the
    loading
    of
    the
    trucks
    and
    releasing
    the
    trucks
    with
    the
    material
    in
    question
    under
    his
    supervision.
    After
    gathering
    all
    information
    and
    meeting
    with
    Chuck
    Webber-
    CTA
    and
    Paschen
    Construction,
    it
    was
    found
    that
    the
    CTA,
    Paschen,
    E.
    King
    and
    Mr.
    Gonzalez
    were
    under
    an
    agreement
    to
    store
    fuel-
    contaminated
    soil
    from
    the
    CTA
    Brownline
    project
    at
    the
    1601
    E.
    130th
    St.,
    until
    the
    CID
    Landfill
    resumed
    business
    on
    Monday.
    Further
    information
    also
    was
    given
    that
    the
    material
    was
    questionable
    on
    the
    generation
    point
    (
    Browriline)
    and
    that
    there
    would
    be
    an
    ongoing
    investigation
    on
    the
    behalf
    of
    the
    CTA.
    Inspector
    Maciel,
    Ms.
    Pottoff,
    Mr.
    King,
    Mr.
    Kryl,
    and
    myself
    discussed
    the
    sites
    condition
    with
    Chuck
    Webber
    and
    a
    representative
    from
    Paschen
    Construction.
    Mr.
    Webber
    is
    a
    CTA’s
    environmental
    consultant
    in
    charge
    of
    the
    brown
    line
    project
    and
    Paschen
    was
    the
    hired
    subcontractor
    to
    do
    the
    renovation.
    They
    both
    informed
    us
    that
    the
    CTA
    material
    that
    was
    removed
    from
    the
    project was
    to
    go
    to
    CID
    landfill.
    However,
    since
    the
    renovation
    work
    occurred
    over
    the
    weekend
    the
    loads
    would
    have
    to
    wait
    to
    go
    to
    the
    landfill
    until
    Monday.
    Mr.
    Webber
    also
    informed
    us
    that
    E.
    King
    was
    hired
    to
    do
    the
    hauling.
    He
    said
    that
    E-King
    was
    to
    keep
    all
    the
    loads
    in
    roll-offs
    and
    on
    site
    until
    CID
    opened.
    Neither
    Mr.
    Webber
    nor
    Paschen
    could
    conclude
    if
    the
    waste
    material
    came
    from
    the
    brown
    line
    project.
    The
    total
    amount
    of
    debris
    waste
    from
    CTA
    equaled
    800
    yards.
    This
    waste
    consisted
    of
    bricks,
    wood,
    scrap
    metal,
    soil,
    and
    concrete.
