Dear Ms. Powell:
I have prepared this letter to respond to the above-referenced Administrative Citation issued by
your office for the Veolia ES Valley View Landfill ("Veolia"), as received on May 15'", 2007 .
The subject Administrative Citation identified alleged violations and deficiencies relative to the
Illinois Environmental Protection Act (Act), 415 ILCS 5/4(r) (2006), and the above referenced facility's
permit . The specific issues constituting the alleged violations and a copy of the complete Notice are
attached hereto as Exhibit A of this letter .
Veolia has reviewed the Administrative Citation and developed a plan to remedy any
deficiencies . It is the opinion of Veolia that the alleged violations have occurred due to inadequate daily
cover procedures previously in place at the facility as well as the need for additional training of the
facility operators . Below are the alleged violations, suggested corrective actions as well as Veolia's
responses :
Alleged Violations :
"A violation of Section 21(d)(1) is alleged because waste was disposed of and/or stored in
violation of permit conditions"
"A violation of Section 21(d)(2) is alleged because waste was disposed of and/or stored in a way
that violates regulations and standards adopted by the Board ."
"A violation of Section 21(e) is alleged because waste was disposed of
and/or stored in a manner
that does not meet the requirements of the Act."

"A violation of Section 11, Part 2(e) of Permit 1995-198-LF is alleged because uncovered refuse
was observed in the active area during the inspection
."
"A violation of Section 11, Part 2(i) of Permit 1995-198-LF is alleged because litter was observed
during the inspection ."
"A violation of Section II, Part 5(d) of Permit 1995-198-LF is alleged because weather conditions
adversely affected the ability of the ADC to prevent the blowing of litter and vectors
."
"A violation of Section II, Part 5(f) of Permit 1995-198-LF is alleged because inaccurate
information was recorded in the ADC records at the time of the inspection
."
"A violation of Section II, Part 5(p) is alleged because the ADC failed to meet the requirements
of 35 IAC, 811 .I06(b)(1) and 8I I .106(b)(2)."
Required Corrective Actions :
"# 1 Provide daily cover on all uncovered refuse by the end of the operating day ."
"#2 Immediately collect and contain all litter from the site by the end of the operating day
."
Response :
Veolia has completed corrective action #1 and has placed daily cover materials on all areas of
uncovered refuse
. Veolia will continue to monitor the landfill daily to determine additional areas
which require daily cover placement
.
Veolia has completed corrective action #2 and has taken all actions to immediately collect all
litter from the site by the end of each operating day. These actions include but are not limited to
the staffing of temporary labor, utilization of wind collection fences and covering additional areas
with daily and intermediate cover .
In addition, Veolia has taken the following actions to prevent the above violation from re-occurring
:
Veolia has re-trained all its employees on the proper procedures for daily cover placement as well
as litter control ;
Veolia has purchased additional approved alternate daily covers (tarps) for use in maintaining
complete coverage of the active areas ;
Veolia has initiated additional check and balance procedures to be followed to ensure proper
cover placement is occurring .

 
a Veolia Management will review the ADC logs for accuracy on a daily basis
.
Based on the site inspection by the Macon County Solid Waste Management Department on May
18, 2007,
all of the above referenced violations have been corrected
.
Veolia elects not to petition the Illinois Pollution Control Board for review of the Administrative
Citations and accordingly, has enclosed a receipt from the Macon County Planning & Zoning Department
showing payment of $1,000 .00 on May
18, 2007 as received by Mrs. Black - Secretary, as well as the
required Remittance Form .
Veolia is committed to maintaining compliance with the Act, the respective permits, and the
applicable regulatory requirements
