That Clinton D
. and Ruth H
. Jordan are the present owners ("Respondents') of a
facility located at 15965 Dwina Road, Marion, Williamson County, Illinois
. The property is
commonly known to the Illinois Environmental Protection Agency as Pittsburg/Jordan
.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No
. 1998595010
.
3.
That Respondents have owned said facility at all times pertinent hereto
.

That on April 23, 2007, Sheila Williams of the Illinois Environmental Protection
Agency's Springfield Regional Office inspected the above-described facility
. A copy of her
inspection report setting forth the results of said inspection is attached hereto and made a part
hereof .

VIOLATIONS
Based upon direct observations made by Sheila Williams during the course of her April 23,
2007 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the "Act") as follows :
(1)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004).
(2)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3)
(2004) .
(3)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in deposition of general construction or demolition debris or clean
construction or demolition debris, a violation of Section 21(p)(7) of the Act, 415
ILCS 5/210)(7) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondents are
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500
.00) for each of the
violations identified above, for a total of
Four Thousand Five Hundred Dollars ($4,500
.00). If
Respondents elect not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than
July 15, 2007,
unless otherwise provided by

order of the Illinois Pollution Control Board .
If Respondents elect to contest this Administrative Citation
by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415
ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged
herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs
incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board .
Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00)
statutory civil penalty for each
violation
Pursuant to Section 31 .1
(d)(1) of the Act, 415 ILCS 5/31

(2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution
Control Board for review of this Administrative

When payment is made, Respondents' check

Affiant, Sheila Williams, being first duly sworn, voluntarily deposes and states as follows :
1 . Affiant is a field inspector employed by the Land Pollution Control Division of the
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto .
2. On April 23, 2007, between 10 :30 a .m. and 11 :50 a .m., Affiant conducted an
inspection of a disposal site operated by Clinton & Ruth Jordan, located in Williamson County,
Illinois, and known as Pittsburg/Jordan by the Illinois Environmental Protection Agency . Said
site has been assigned site code number 1998595010 by the Agency
.

. Affiant inspected said Pittsburg/Jordan site by an on-site inspection which included
walking and photographing the site

GENERAL REMARKS
On April 23, 2007 I conducted an inspection of the Pittsburg/Jordan dump site
. The
initial inspection was conducted on January 18, 2007
. However, not a full inspection
was done . Mr. Jordan insisted that no pictures be taken (three were taken from off-
site) . At one point Mr. Jordan said he did not want me to look at a certain area
. It was
at that time Robert Mileur & I left the site
. During the first inspection, Mr
. Jordan was
clearly unhappy with our presence & yelled much of the time
. Immediately after
leaving the site while taking pictures standing on the county road, Mr
. Jordan drove his
car within about three feet of my person while yelling that I could not take pictures
.
Due to the problems presented by Mr
. Jordan in conducting the January 18, 2007
inspection, I was accompanied by Deputy Maeser of the Williamson County Sheriff's
Department for the current inspection .
Upon arrival, Deputy Maeser & I went to the front door of the Jordans' home
. I told
Mr
. Jordan my name, the Agency I represent & that I was requesting permission to
conduct an inspection . Mr
. Jordan began yelling at me
. After Deputy Maeser spoke to
Mr
. Jordan, he quieted down somewhat
. When I requested access to the site, Mr
.
Jordan said he did not want me to take any pictures & there were certain areas where I
could not go
. I told him if I was to do the inspection, I would be taking pictures &
going to any part of his property
. After some discussion, Mr . Jordan gave me

permission to conduct the inspection
. During the course of the inspection, the following
information was provided :
- Mr . Jordan said he had been working on the site since the last time I was there
.
(The only difference noted was that one of the vehicles pictured during the first
inspection was no longer present .)
-
He & his wife are both going to have surgeries in the near future . Mr. Jordan
wanted to know how they are supposed to be able to clean things up
. I told him
they can hire someone or perhaps have their son help out (Mr
. Jordan had
previously mentioned that their son is not currently working
.)
-
He wanted to know why his neighbor to the south of him was allowed to burn & he
isn't
. (His neighbor appeared to be burning landscape waste at the time of the
inspection . I told Mr. Jordan people may burn landscape waste but not electronics
as he had been doing.)
- Mrs . Jordan said she needs to use the pool for therapy
. She said they will be
getting it ready to use soon .
- Mrs
. Jordan said that they had called someone in Springfield who had told them it is
ok to have the vehicles
. I suggested that if that person had seen the conditions of
some of the vehicles - such as tires being sunk into the ground
- they may have
received a different response
. Deputy Maeser added that whoever it was she spoke
with was probably with a different Agency, but I was there to address
environmental issues .
- Mr
. Jordan asked if he could keep the cars if he were to put up a fence
. I told him
a fence won't make any difference if they are still in the same condition as they
were during the inspection
. Although, I did try to differentiate between some of the
vehicles . I told him the green Mustang near the house appeared to be of value
partly because it was not storing waste & the tires had not sunk into the ground like
some others . Mr
. Jordan inquired about putting up a building & storing the vehicles
in it
. I said that should be fine .
Other than scattered refuse, six areas of apparent violations were observed
. These
have been designated as Area A - Area F
. Among the scattered wastes were four tires,
demolition wood, a variety of metal, PVC piping, metal drums (apparently empty),
vehicle parts, cardboard, plastics & two push mowers
.
Area A consisted of an apparent burn pile
. Area A appeared to be a burn pile due to
the typical indicators such as a pyramid shaped pile, ash & blackened refuse in the
central portion of the pile & the amount of blackened refuse decreasing as the outer
z

 
perimeter of the pile was approached
. Wastes observed in the burn pile were a tire, tire
wires, charred furniture & a blackened tree trunk
. It was apparent the tires had been
burned at this location because of the uniform consistency of the tire wires
. Area A
was estimated to be approximately two cubic yards (7
.5'x5'xl
.5') in size .
Among the refuse in Area B were demolition debris, carpeting, a broken wheel barrel
& a metal tub
. It was apparent the metal tub had been used for burning waste
. In &
on the tub were charred electronics, pieces of metal, wire, charred wood, ash &
unidentifiable items
. Other than the blackened materials & ash in & around the tub, it
was apparent it had been used for burning because there was a grayish
- black
material that appeared to have melted & formed to the shape of the tub
. Because of
the multiple pieces of charred metal & wire resting on the outer rim of the tub, it is
apparent these items had been burned with the intent of scavenging them for the
metal
. Area B was estimated to be approximately six (30'x5'xl') in size
.
Area C consisted of 28 tires
. Area C was estimated to be approximately three cubic
yards (5'x5'x3') in size .
Refuse in Area D included, but was not limited to, approximately 75 tires, demolition
debris, two bicycles, seven lawnmowers, cardboard, broken glass, an electric outlet
box, fluorescent light bulbs, a lawn mower motor, foam padding, a variety of metal &
seven vehicles (one of these consisted of only the front seat area of the vehicle which
had been heavily gutted)
. Six of the seven vehicles either contained or were covered
with debris exposed to the elements
. Two of the tires on a red truck had sunk into the
ground
. Also, observed in Area D was another metal tub apparently used to burn
waste
. It contained, metal cans, wires, glass & ash
. Area D was estimated to be
approximately 382 cubic yards( 62
.5'x5 .5'x3') in size
.
Area E was the bed of a truck converted to a trailer that contained a variety of metal,
worn vehicle parts & a tape player exposed to the elements
. Area E was estimated to
be approximately two cubic yards (5'x6'x2') in size
.
Among the waste in Area F were 10 tires, a carpet pad, a variety of metal,
electronics, four riding lawn mowers, a truck bed containing waste, demolition debris,
Christmas decorations, glass windows & doors, a chair, a wood cabinet, a lawn mower

motor & electric cords
. Eleven vehicles were present in Area F
. Two of these vehicles,
a light blue Mustang & a yellow & white Ranger truck had tires that were partially sunk
into the ground
. Five of the eleven vehicles had refuse either in or on them that was
exposed to the elements
. Some of these wastes were vehicle parts, cardboard & metal
.
Area F was estimated to be approximately 174 cubic yards (62
.5'x30'x2
.5') in size .
