    ORDER OF THE BOARD (by G.T. Girard):
    On January 26, 2007, the Board, at the parties’ request, extended until April 9, 2007, the
    time period within which Siemens Energy & Automation (Siemens) may appeal a December 14,
    2006 determination of the Illinois Environmental Protection Agency (Agency).

    5/40 (a)(1) (2004); 35 Ill. Adm. Code 105.406. The Agency approved, with conditions and
    modifications, Siemens’ request to modify various previously-approved Site Remediation
    Program documents (Comprehensive Site Investigation Report, Remediation Objective Report
    and Remediation Action Plan). These documents concern Siemens’ leaking underground
    petroleum storage tank facility located at 100 McKee Street in Batavia, Kane County. Because
    Siemens failed to timely file an appeal, the Board dismisses this case and closes the docket.
    IT IS SO ORDERED.
