ORDER OF THE BOARD (by A.S. Moore):
On May 1, 2007, Freedom Oil Company (Freedom) filed a motion (Mot.) to voluntarily
dismiss these consolidated underground storage tank (UST) appeals. In the motion, Freedom
reports that a February 2, 2006 Board order “resolved some but not all of the factual issues raised
in these proceedings.” Mot at 1. Freedom further reports that, “subsequent to the Board’s
decisions, the Petitioner and I[llinois] E[nvironmental] P[rotection] A[gency] met and resolved
all of the remaining issues raised in these proceedings.”
Id
. Freedom states that it “has now
received the full settlement amount agreed to between the parties, and no outstanding issues
remain to be argued in these appeals.”
Id
.
The Board grants Freedom’s motion to voluntarily dismiss these consolidated appeals,
dismisses the five consolidated cases, and closes the five dockets.
IT IS SO ORDERED.
