HEARING OFFICER ORDER
On May 3, 2007, the parties informed the hearing officer that they are at present
discussing the above-captioned matter in an attempt to arrive at settlement. The petitioner
represented that it will file an open waiver of the statutory decision deadline.
On May 3, 2007, the respondent filed a motion for an extension of time to file the
administrative record. The record was due to be filed on April 20, 2007. The respondent
represents that continuing discussions may resolve this matter. The respondent also represents
that the petitioner is in agreement. The respondent’s motion is granted and the record is now due
on or before August 10, 2007.
The parties or their legal representatives are directed to participate in a telephonic status
conference on August 9, 2007, at 9:00 a.m. The status conference must be initiated by the
petitioner, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
