)FACTS
1 .
That Respondent, BFI Waste Systems of North America, Inc
., is the permitted
owner of a facility located at 8902 N
. IL Rt
. 251, Davis Junction, in the County
of Ogle, State of Illinois .
2.
That said facility, Davis Junction Landfill, is a closed landfill, operating under
Illinois Environmental Protection Agency Operating Permit No
. 1994-160-LF,
and designated with Site Code No
. 1418210001
.
3 .
That Respondent has owned or operated said facility at all times pertinent
hereto.
4.
That Joy K
. Bliton of the Ogle County Solid Waste Management Department,
inspected said facility on February 28, 2007
. A copy of the inspection report
setting forth the results of such inspection is attached hereto and made a part

 
hereof.
On April 2, 2007, the Ogle County Solid Waste Management Department
received from the IEPA, a copy of the cover page of the 2005 Annual Report
for the Davis Junction Landfill, the LPC 591 Form and the cover letter from
Weaver Boos Consultants, all with the IEPA date received stamp of March 7,
2007.
VIOLATIONS
On the basis of direct observation by Joy K . Bliton, the County of Ogle has determined
that Respondent was conducting a sanitary landfill operation at the above-described facility,
which is required to have a permit pursuant to 415 ILCS 5/21(d), in a manner which resulted in
the following conditions :
A.
Failure to submit reports required by Permit or Board regulations, in violation of
415 ILCS 5/21(o)(11) .
CVIL PENALTY
Pursuant to 415 ILCS 5/42(b)(4), Respondent herein is subject to a civil penalty of Five
Hundred Dollars ($500 .00) for each violation specified above in Paragraph A, for a total of Five
Hundred Dollars ($500.00). Additionally, should Respondent elect to petition the Illinois
Pollution Control Board under the review process described herein below, and if there is a
fording of the violations alleged herein, after an adjudicatory hearing, Respondent shall be
assessed the associated hearing costs incurred by Ogle County and the Illinois Pollution Control
Board, in addition to the Five Hundred Dollar ($500 .00) statutory penalty for each finding of
violation .

 
If Respondent acknowledges the violations cited hereinabove, the civil penalty shall be
due and payable no later than thirty-five (35) days from the date of service hereof
. If Respondent
does not petition the Pollution Control Board for review of this Administrative Citation within
thirty-five (35) days of service hereof or if Respondent elects to contest this Administrative
Citation, any judgment rendered against Respondent shall specify the due date of the statutory
civil penalty and any costs assessed against Respondent
.
When payment is made, Respondent's check should be made payable to Ogle County Solid
Waste Fund and mailed to the Ogle County Treasurer, Ogle County Courthouse, P
.O
. Box 40,
Oregon, IL 61061
. Respondent shall complete and return the enclosed Remittance Form to
ensure proper documentation of payment
.
If any civil penalty, by reason of acknowledgment, default or finding after adjudicatory
hearing, is not paid when due, the Illinois Environmental Protection Agency shall take into
consideration such failure to pay during any permit review process upon Respondent's
application for a new permit or for renewal of an existing permit
. If any civil penalty imposed by
the Illinois Pollution Control Board is not paid within the time prescribed in the order, interest on
such penalty will be assessed for the period from the date payment is due until the date payment
is received
. Furthermore, if payment is not received when due, the Ogle County State's Attorney
shall be requested to initiate proceedings in Circuit Court to collect said civil penalty
. In addition
to the previously assessed civil penalty, interest, and hearing costs of Ogle County and the
Illinois Pollution Control Board, if any, the Ogle County State's Attorney's Office will seek to
recover their costs of litigation
.

 
PROCEDURE FOR CONTESTING THIS ADMINISTRATIVE CITATION
Respondent has the right to contest this Administrative Citation
(See 415 ILCS 5/31 .1).
If Respondent elects to contest this Administrative Citation, Respondent must file a Petition for
Review with the Clerk of the Illinois Pollution Control Board
. A copy of the Petition for Review
must also be filed with the Ogle County State's Attorney's Office
. Such Petition for Review
must be filed within thirty-five (35) days of the date of service of this Administrative
Citation, or a Default Judgment against you shall be entered by the Pollution Control
Board.
Your original Petition must be filed with the Clerk of the Illinois Pollution Control Board

General Remarks
I arrived at the Davis Junction landfill at 8
:55 a .m
. Jim Hitzeroth arrived at 9 :26 a.m. and we
started our inspection of the site .
I had called Jim on February 23, 2007 to set up an appointment for an inspection on February 28,
2007
. During that phone conversation, I informed him that we had not received a 2005 Annual
Report from them. He said that he would send me a copy
. At our inspection on February 28,
2007, Jim said that Weever Boos consultants were going to Fed Ex a copy to me and it has
probably already been sent.
We drove over to the leachate tanks
. Leachate was being pumped from the #2 tank to the tanker
truck. Jim and I then walked onto the landfill
. We stopped at various extraction wells
. Some of
the wells will need well boot repairs as the boots have settled
. One extraction well had a vacuum
leak and will need to be repaired
.
We walked along, stopping at various extraction wells
. We noted ponded water south of EW
#30 and northwest of EW #18
. These low areas will need to be filled to facilitate drainage, as
required by the permit and post closure care plan
. According to 35 Illinois Administrative Code,
Section 811
.322(b), all slopes shall be designed to drain run off away from the cover and which
prevents ponding
. No standing water shall be allowed anywhere in or on the unit
.
By March 30 of each year, annual inspections shall be conducted of the vegetative cover until
settling has stopped and there are no eroded or scoured areas
. Any rills, gullies, crevices, eroded
and scoured drainage channels, holes, depressions created by settling, failed or eroded vegetation
in excess of 100 square feet cumulatively must then be repaired
.
I looked at two ground water monitoring wells
. They were only labeled with the Applicant's
designation
: # 179D and # 1711
. The Illinois EPA designations for these two wells are G79D and
G71 M, respectively. The caps were on and padlocked
. The gas probe # 09 also had a cap on and
was padlocked .
We walked back to the vehicles
. I left the site at 10 :20 a
.m.

 
I had contacted the IEPA a number of times during February and early March to discuss whether
they had received the Davis Junction Landfill, 2005 Annual Report. They checked their records
and were unable to locate it.
I received a copy of the 2005 Annual Report from Weever Boos Consultants on March 9, 2007
.
The cover letter was missing
. I called Jim Hitzeroth on March 12, 2007 . I told him that I
received a copy of the 2005 Annual Report but the dated cover letter was omitted
. I asked him if
he knew when it was submitted . He said he did not know . He would check on it
. I then
received a call from Beth Steinhour of Weever Boos Consultants who said that the report was
just submitted to the IEPA last week
. She said it had been completed but was never submitted .
On March 16, 2007, the OCSWMD received from Weever Boos Consultants the cover letter for
the 2005 Annual Report . The letter was not dated .
On April 2, 2007, the OCSWMD received the IEPA date-stamped cover letter from the IEPA
(dated March 7, 2007) . This confirms the 2005 Annual Report was not received by the IEPA by
the required date of May 1, 2006 .
