UNOPPOSED MOTION TO FILE CERTIFICATE OF PUBLICATION
Cabot Corporation ("Cabot"), through its attorneys, Seyfarth Shaw LLP, and
pursuant to 35 111
. Admin. Code § 101 .500, moves for leave to file the Certificate of
Publication, as required by 35 111
. Admin Code § 140 .410. In support of this motion,
Cabot states as follows :
1 .
On April 12, 2007, Cabot filed a Petition for Reissuance of Adjusted Standard
("Petition") from 35 Ill
. Admin Code, Part 738, Subpart B for underground injection
control
("UIC") Wells Nos . 2 and 3 at its Tuscola, Illinois facility ("Facility")
.
2.
Subsequently, on April 13, 2007, Cabot purchased space to publish notice of the
Petition's filing in The Tuscola Review ("Notice"), a weekly secular newspaper of
general circulation in the area likely to be affected by the Petition
.
3 .
The Tuscola Review agreed to publish notice of the Petition's filing on Friday,
April 20, 2007, well within the fourteen day period prescribed by 35 Ill
. Admin Code §
140.408(a).
4.
By its own mistake, The Tuscola Review failed to publish the Notice on that date
.
5 .
Upon learning of the newspaper's error, Cabot insisted that The Tuscola Review
publish the Notice in its next edition, dated April 27, 2007
.
6.
The Notice was in fact published in The Tuscola Review on April 27, 2007, the

fifteenth' day after Cabot filed the Petition .
7.
The substance of the Notice complies with the requirements of 35 111 . Admin
Code § 104 .408(b).
8 .
In light of these circumstances, Cabot moves for leave to file the attached
Certification of Publication and relief from the requirement that the Notice have been
published within fourteen days of the Petition's filing .
9 .
The Illinois Environmental Protection Agency does not oppose this motion
.
WHEREFORE, Cabot Corporation respectfully requests that the Board grant it
leave to file the attached Certificate of Publication and relief from the requirement that
the Notice have been published within fourteen days of the Petition's filing
.
