That Herman F
. and Karen Meyers ("Respondents") are the present owners and
operators of a facility located at 5328 Staton Ridge Road, Belknap, Massac County, Illinois
. The
property is commonly known to the Illinois Environmental Protection Agency as Belknap/Meyers,
Herman .

That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No
. 1278015003 .

That Respondents have owned and operated said facility at all times pertinent hereto
.
4.
That on January 31, 2007, Maggie Stevenson of the Illinois Environmental Protection
Agency's Marion Regional Office inspected the above-described facility, A copy of her inspection
report setting forth the results of said inspection is attached hereto and made a part hereof
.

VIOLATIONS
Based upon direct observations made by Maggie Stevenson during the course of her
January 31, 2007 inspection of the above-named facility, the Illinois Environmental Protection
Agency has determined that Respondents have violated the Illinois Environmental Protection Act
(hereinafter, the "Act") as follows
:

That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004)
.
(2)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3) (2004).
That Respondents caused or allowed the open dumping of waste in a manner
resulting in deposition of waste in standing or flowing waters, a violation of Section
21(p)(4) of the Act, 415 ILCS 5/21(p)(4) (2004)
.
(4) That Respondents caused or allowed the open dumping of waste in a manner
resulting in deposition of general construction or demolition debris
; or clean
construction or demolition debris, a violation of Section 21 (p)(7)
of the Act, 415 ILCS
5/21 (p)(7) (2004)
.

CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondents are
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500 .00) for each of the
violations identified above, for a total of
Six Thousand Dollars ($6,000 .00).
If Respondents elect not
to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be due
and payable no later than
April 30, 2007, unless otherwise provided by order of the Illinois Pollution
Control Board .
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415 ILCS 5/31
.1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board
. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00) statutory civil penalty for each
violation .
Pursuant to Section 31 .1 (d)(1)
of the Act, 415 ILCS 5/31 .1 (d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondents check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P

. Along with payment, Respondents shall complete and return the enclosed

If any civil penalty and/or .hearing costs are not paid within
the time prescribed by order of the
Illinois Pollution Control Board, interest on
said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received . The Office of the Illinois Attorney General
may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued .

ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31
.1 of the Act, 415 ILCS 5/31/1 (2004). If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276 . Section 31 .1 of the Act provides that any Petition for Review shall be filed within

Affiant, Maggie Stevenson, being first duly sworn, voluntarily deposes and states as follows :
1 . Affiant is a field inspector employed by the Land Pollution Control Division of the
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto .

. On January 31, 2007, between 11 :45 AM and 12 :00 PM, Affiant conducted an
inspection of a disposal site operated by Herman F . and Karen Meyers, located in Massac
County, Illinois, and known as Belknap/Meyers, Herman by the Illinois Environmental
Protection Agency . Said site has been assigned site code number 1278015003 by the Agency
.
3 . Affiant inspected said Belknap/Meyers, Herman site by an on-site inspection which
included walking and photographing the site .

. As a result of the material actions referred to in paragraph 3 above, Affiant completed
the Inspection Report form attached hereto and made a part hereof, which, to the best of Affiants

This inspection was made as a follow-up to a March 22, 2006 inspection
. The site is located at 5328 Staton Ridge
Road, in Belknap, Illinois . The site was easily visible from Staton Ridge Road
. Garrison Gross accompanied me on
the site inspection . At least four dogs were chained on the property (some pitbull mix and rotweiler)
. Twenty-one
pictures were taken of the waste from on-site . We knocked on the door of the residence but there was no answer
.
There were at least six vehicles at the front of the property that displayed current Illinois license plates (Ford Crown
Victoria, 8883847 ; Dodge Dakota, 900445 ; Dodge Ram, 4415XH
; Dodge Neon, 8982819 ; Chrysler Concorde,
8399681 ; and Pontiac Trans AM, Moms TAZ . No business signs were readily visible on the property
.
According to Secretary of State Police, Mr. Meyers has been investigated on two occasions for running an unlicensed
junkyard, once in 1998 and again in 2000 . At the time of the 2000 investigation, it was reported that Ms
. Meyers
stated they did not sell any parts off the vehicles . Mr
. Meyers was served with a Cease and Desist Order from
Secretary of State in 2000 .
There were at least 35 unlicensed vehicles located on this property (pictures 001-007, 009, 010-021)
. The vehicles
were of various makes, models, and years
. Vehicles were filled with waste, both inside passenger compartments
(picture 015) and beds of pickups (pictures 001, 006, 013, 014, 019, and 020)
. Scrap metals, C & D materials,
fencing, a water heater, tires, and lumber in the beds of pickups were exposed to the elements and unprotected
.
Vehicles were missing components (picture 016) .
There were at least three areas of improper tire storage located on the property
. Area A consists of vehicles and
miscellaneous waste . Area B contains tires scattered throughout the area, vehicles with missing components and
exposed to the elements, scrap metal, 55-gallon drums, and miscellaneous debris (pictures 003, 004, 005, 007, 008,
009, 019, and 020). Area B contains approximately 120 tires . Pictures 006 and 007 show locations within Area B

 
where tires, both off and on rims, were piled
. Area C contained approximately 15 tires, vehicles with missing
components and exposed to the elements, 55-gallon drums, and miscellaneous debris (pictures 009 and 010)
. Areal)
contained scattered debris in standing, frozen water and in a meadow area (pictures 011 and 012)
. According to a
phone conversation with Herman Meyers on April 12, 2006, the meadow area is the location where waste burial had
previously taken place
. Area E includes vehicles loaded with miscellaneous debris and tires that are on and off rims
(pictures 013 and 014) . Passenger compartments of vehicles are loaded with waste such as appliance parts, boxes,
electronic equipment, and metal scraps (picture 015)
. Vehicles are not drivable and have missing components
(picture 016) .
Additional vehicles and waste have been brought onto the site since the March 22, 2006 inspection . Waste
previously identified during the September 29, 2000 inspection, June 14, 2001 inspection, and March 22, 2006
inspection remain on site .
The following conditions, which constitute violations, were observed :

Findings :
The location remains a scenic blight with the continual accumulation of waste
haphazardly collected for an extended period of time
. Mr. Meyers has failed to supply the
Illinois EPA with receipts for waste removed from his property in accordance with the
Open Dump Administrative Citation Warning Notice issued October 18, 2000 or the Open

 
Dump Administrative Citation Warning Notice issued April 4, 2006
. The method of
improper storage for many items referenced in the photographs taken of this property
since September 29, 2000 (tires, lead acid batteries, abandoned vehicles, C & D debris,
general refuse) creates a potential environmental hazard
. Items are not being salvaged as
defined in 35 Illinois Administrative Code
. According to the Secretary of State, Mr
.
Meyers does not possess a license as defined for a rebuilder, repairer, automotive parts
recycler, or scrap processor
. Open burning and burial of waste has taken place on the
property.
