    ORDER OF THE BOARD (by G.T. Girard):
    On November 16, 2006, the Board, at the parties’ request, extended until
    February 12, 2007, the time period within which Knapp Oil Company, Inc. (Knapp Oil) may
    appeal an October 5, 2006 determination of the Illinois Environmental Protection Agency
    (Agency).

    415 ILCS 5/40 (a)(1) (2004); 35 Ill. Adm. Code 105.406. The Agency rejected
    Knapp Oil’s Amended High Priority Corrective Action Plan Budget because it did not include
    amendments requested by Agency letter of July 17, 2006. The leaking underground petroleum
    storage tank facility is located at 1117 East Fifth Road, Metropolis, Massac County. Because
    Knapp Oil failed to timely file an appeal, the Board dismisses this case and closes the docket.
    IT IS SO ORDERED.
