ORDER OF THE BOARD (by N.J. Melas):
On February 9, 2007, Peoria Disposal Company (PDC) moved to file a post-hearing brief
in excess of 50 pages. 35 Ill. Adm. Code 101.302(k). The motion states that the Peoria County
Board (County) has no objection to the motion. PDC filed the post-hearing brief, totaling 113
pages plus attachments, on February 16, 2007. To date, the County has not responded to PDC’s
February 9, 2007 motion. A party that fails to object to a motion is deemed to have waived any
objection to the Board granting the motion. 35 Ill. Adm. Code 101.500(d). The Board grants
PDC’s motion and accepts the post-hearing brief.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on March 1, 2007, by a vote of 4-0.
    Dorothy M. Gunn, Clerk
