This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31 .1 of the Illinois Environmental Protection Act, 415
ILCS 5/31 .1 (2004) .
FACTS
1 .
That Adolph M . Lo ("Respondent") is the present owner of a facility located at 1343
CR 200E Seymour, Champaign County, Illinois . The property is commonly known to the Illinois
Environmental Protection Agency as Seymour/LoFarms-1343 CR 200E Seymour.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No . 0198205006 .
3.
That Respondent has owned said facility at all times pertinent hereto
.
4.
That on January 30, 2007, Mike Mullins of the Illinois Environmental Protection
Agency's Champaign Regional Office inspected the above-described facility. A copy of his
inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.

VIOLATIONS
Based upon direct observations made by Mike Mullins during the course of his January 30,
2007 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows :

That Respondent caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004) .
(2)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3)(2004) .
That Respondent caused or allowed the open dumping of waste in a manner
resulting in Deposition of General Construction or Demolition Debris : or Clean
Construction or Demolition Debris a violation of Section 21(p)(7) of the Act, 415
ILCS 5/21(p)(7) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondent is
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500
.00) for each of the
violations identified above, for a total of Four Thousand Five Hundred Dollars ($4,500 .00).
If
Respondent elects not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than April 30, 2007, unless otherwise provided by
order of the Minois Pollution Control Board .

If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415 ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board . Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00) statutory civil penalty for each
violation .
Pursuant to Section 31
.1(d)(1) of the Act, 415 ILCS 5/31 .1 (d)(1) (2004), if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondent's check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276
. Along with payment, Respondent shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment
.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondent from the date payment is due up to and including the date that payment is
received . The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

Respondent has the right to contest this Administrative Citation pursuant to and in
accordance with Section 31 .1 of the Act, 415 ILCS 5/31/1 (2004) . If Respondent elects to contest

Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P .O

Illinois 62794-9276 . Section 31 .1 of the Act provides that any Petition for Review shall be filed within

Ownership : Confirmed by deed from Champaign County Recorder's Office and the
Champaign County Platbook both show ownership as Adolph M . Lo.
Administrative Citation Warning Notice sent October 19, 2006 gave the property owner until
December 15, 2006 to bring the site into compliance . No additional time was requested by the
property owner to bring the property into compliance with the Illinois Environmental
Protection Act and Regulations . A site re-inspected on December 15, 2006 resulted in
continuation of the same violations
.
I was contacted at home late afternoon on January 29, 2006 and informed that the demolished
buildings at this site were on fire and the waste that had been near the entrance to the property
was no longer there .
The purpose of this inspection was to determine regulatory status and evaluate compliance
with the Environmental Protection Act (Act) and Title 35 Illinois Administrative Code,
Subtitle G: Land Pollution (Regulations) .
January 30, 2007 Observations :
I arrived on site at approximately 10 :20 a .m. to finish the investigation of a complaint
received on January 29, 2007 . The weather was clear and sunny, 12 degrees and very windy
from the west . Estimated wind speed was 15-20 miles per hour .
The pile of demolition debris that had been observed the previous two inspections was now
scattered between the partially demolished room and the debris pile (photos 1,2,3) . Mixed
with this debris was pink batten type insulation
. This scattered insulation had not previously
been observed on this site (photos 1,2,3) . The household waste that had been previously
observed near the partially demolished room was no longer observed .
I next inspected the debris pile that was located southwest of the house . Initial observation
was smoke from smoldering debris in the pile (photo 4) . Upon closer inspection, I observed
partially burned dimensional lumber, insulation, ash, and items that would not burn like metal
mesh, paint can, rock, concrete blocks, lawn furniture, tractor parts and concrete (photos

 
5,6,7,8). The southern part of the debris pile did not burn very well and observed in the pile
was a tire, white painted lumber, sheet or galvanized metal, a branch and plastic (photo 8)
.
Observed behind the white polebarn/machine shed was another debris pile consisting of tires,
metal sheeting, metal fence materials and an anhydrous ammonia tank (photo 9) . It is
unknown how long this debris has been piled behind the machine shed . This area had not been
previously inspected or observed until this date .
I then went to the area near the entrance that was the location of a household debris pile
during the previous two inspections . The household debris pile was no longer observed in that
location . Small pieces of plastic, glass, paper and insulation were observed near the entrance
of the site (photos 10,12) . Also observed was pink insulation scattered into the farm field to
the east of the site and on the east side of County Road 200 East (photo 11) . The insulation
was also observed south of the site in the farm field on the west side of County Road 200E
(photo 13) .
I left the area at 10:45 a.m .
After returning to the office, I called Renee Lo to inform her that the pink insulation from her
property had blown across the road and into the neighboring farm field . Mrs. Lo was unaware
that the insulation had blown
. I requested that she pick up the insulation before we get
additional complaints about the litter .
I also inquired if Mrs . Lo was aware that a fire was on-going at this site? Mrs . Lo claimed
that it was arson and the Sheriff's Department was looking for the people.
Apparent violations observed during this inspection :

burning, which would cause or tend to air pollution in Illinois was observed
during this inspection.
