    ORDER OF THE BOARD (by G.T. Girard):
    On December 7, 2006, at the parties’ request, the Board extended until
    February 12, 2007, the time period within which Noveon, Inc. (Noveon) may appeal an
    October 2, 2006 determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40 (a)(1) (2004); 35 Ill. Adm. Code 105.206. The Agency denied a Lifetime State
    Air Operating permit for various emissions units involving manufacturing ink additives. The
    Agency determination concerns Noveon’s facility located at 9550 West 55th Street in McCook,
    Cook County.
    On February 7, 2007, before the extended appeal period expired, Noveon filed a motion
    to voluntarily dismiss this proceeding. Noveon states that the Agency issued a revised operating
    permit on January 18, 2007, and does not object to the dismissal of this case. The Board grants
    Noveon’s motion and closes the docket.
