JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31
.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31 .1 (2004) .
FACTS
That Glen I . and Elizabeth J . Suttles ("Respondents") are the present owners and
operators of a facility located at 387 and 391 West Tremont Street, Waverly, Morgan County, Illinois
.
The property is commonly known to the Illinois Environmental Protection Agency as
Waverly/Suttles .

That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No
. 1378675003
.
3.
That Respondents have owned and operated said facility at all times pertinent hereto
.
4.
That on December 18, 2006, Paul Eisenbrandt of the Illinois Environmental
Protection Agency's Springfield Regional Office inspected the above-described facility
. A copy of
his inspection report setting forth the results of said inspection is attached hereto and made a part
hereof .
VIOLATIONS
Based upon direct observations made by Paul Eisenbrandt during the course of his
December 18, 2006 inspection of the above-named facility, the Illinois Environmental Protection
Agency has determined that Respondents have violated the Illinois Environmental Protection Act
(hereinafter, the "Act") as follows :
(1) That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004) .
(2)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in open burning, a violation of Section 21(p)(3) of the Act, 415 ILCS
5/21 (p)(3)
(2004).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondents are
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500
.00) for each of the
violations identified above, for a total of
Three Thousand Dollars ($3,000 .00).
If Respondents elect
not to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and payable no later than
March 15, 2007,
unless otherwise provided by order of the Illinois
Pollution Control Board .
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415 ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,

Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board
. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00) statutory civil penalty for each
violation .
Pursuant to Section 31 .1
(d)(1) of the Act, 415 ILCS 5/31
.1 (d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation
as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondents check shall be made payable to the
Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal
Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P
.O. Box 19276, Springfield,
Illinois 62794-9276
. Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment
.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received
. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued .

Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31 .1 of the Act, 415 ILCS 5/31/1 (2004) . If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601
. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276 . Section 31 .1 of the Act provides that any Petition for Review shall be filed within
thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondents .

. Affiant is a field inspector employed by the Division of Land Pollution Control/Field
Operations Section of the Illinois Environmental Protection Agency and has been so
employed at all times pertinent hereto .
2 . On December 18, 2006 between 10 :45 AM and 11
:45 AM, Affiant conducted an
inspection of a disposal site operated without an Illinois Environmental Protection
Agency permit, located in Morgan County, Illinois, and known as Waverly/Suttles by the
Illinois Environmental Protection Agency . Said site has been assigned site code number
LPC# 1378675003 by the Illinois Environmental Protection Agency
.

. Affiant inspected said Waverly/Suttles open dump site by an on-site inspection, which
included walking and photographing the site .

. As a result of the activities referred to in paragraph 3 above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which, to the best of
Affiant's knowledge and belief, is an accurate representation of Affiant's observations and
factual conclusions with respect to said Waverly/Suttles open dump

The purpose of this memorandum is to serve as the Narrative Inspection Report Document of a
December 18, 2006 complaint investigation of the above referenced site
. This site was initially
inspected on May 19, 2004
. The complaint alleged the owner was collecting junk and lumber,
purchased from auctions, at the site
. Additional inspections were conducted on January 10,
2005, and May 10, 2005
. This fourth inspection took place from about 10 :45 am to 11 :45 am,
and twenty-two (22) digital photographs were taken
. The weather was sunny and approximately
40°F
. No one was interviewed at the time of the inspection .
The site is located at 387 and 391 West Tremont Street in Waverly, Illinois
. The owners for both
properties are Mr
. Glen I. Suttles and Elizabeth Jane Suttles. Upon arriving at the site, the
Illinois EPA inspector knocked on the front door of their residence . No one answered
. The
inspector's business card was left on the outside of the door
.
Photographs 1 and 2 are street elevation views of the respondent's current and former residence,
respectively . The properties are located adjacent to one another on the north side of W
. Tremont
Street . During the initial inspection Mr
. Suttles stated he purchased items from auctions and
temporarily stores them at this address as wells as his other building on Elm Street
. He uses,
resells, or scraps out the purchased items, or allows them to go to waste
. Mr. Suttles claimed
unusable items are disposed of in the garbage . Mr. Suttles previously stated he bums some of the
wood to heat his home
. Miscellaneous items, scrap metal, and waste are still observed in the
front and side yards of the homes .
Photograph 3 shows a milk crate, cooking pans, plastic buckets, chair cushions, a dolly, a patio
umbrella, a wooden box, a yellow plastic child swing, a flower pot, a plastic bowl, a desk lamp,
electric weed eaters, a pink toilet brush, extension cords, folding chairs, Christmas lights, plastic
crates, shelving, a cardboard box, dimensional lumber, a wheel barrow under a tarp, along with
numerous other items stored in the front yard
.
Photograph 4 shows an old sewing machine, wood tables, black rubber hose, a croquette set,
umbrellas, lawn chairs, a tee ball stand, metal shelf brackets, a milk crate, a broken Coleman

lantern, plastic buckets, plastic storage boxes, fishing poles, wood siding, green clothes line, a
wooden pallet, and numerous other miscellaneous items stored in the front yard of the older
residence .
Photograph 5 shows a makeshift table made out of sawhorses, an interior ceiling fan, a shovel, a
broken pitch fork, several 1-gallon paint cans, a Hoover vacuum, a rusty tool box, a weed eater,
carpet, a wire basket, a circular saw, crutches, storm windows, a satellite dish, and other
miscellaneous debris
.
Photograph 6 shows a pile of OSB cutoffs, a plastic bin, a wood stool, sawhorses, a wood end
table, plastic buckets, a handicap toilet seat, a metal table base, a wheel barrow, a pink child
bicycle, asphalt shingles, and scrap wood that was observed between the two houses .
Photograph 7 shows a patio umbrella, a section of white picket fence, a metal clothes rack, a
wood bookshelf, a console TV, paint cans, cinder block, hoses, a white stove, two household
lamps, and other miscellaneous debris .
Photograph 8 shows the rear entry to the house that is surrounded by stacks of flower pots, an
upright freezer, a Maytag washing machine, a metal rack, glass window panes, and plastic bins
among other items .
Photograph 9 shows a stack of lumber against the former residence . A patio umbrella, storm
windows, black garden edging, a TV antenna, a wooded ladder, piping, rebar, plastic flowers,
and a pickup truck bed trailer full of miscellaneous wood scrap and debris was observed near the
former residence .

I I shows miscellaneous debris stored on pallets behind the travel trailer
. Two dollies, several
wood pallets, rusty lawn chairs, a metal office desk, laundry baskets, scrap wood, plastic buckets,
a chain saw case, box fan grills, and saw horses that were some of the items observed
. Since the
last inspection additional items have accumulated here
.
Photographs 12 and 13 show the burn pile located to the rear of the two backyards
. A metal
frame of a stool, a metal barrel ring, a rusty barrel, scrap metal, pie tins, a Rediwhip aerosol can,
a plastic wrapper from a package of oatmeal cookies, plastic milk caps, an egg, a plastic soap
dispenser, rusty cushion springs, charred wood, landscape waste, house hold waste, and
aluminum cans were among the charred waste observed in the burn pile. Mr
. Suttles has not
cleaned up the charred waste in the burn pile
. The appearance of the burn pile, and the charred
waste not previously seen, indicates open burning is still occurring at the Suttles' property
. In the
background of Photograph 12 is a severely slanted shed and other miscellaneous debris near the
east side of the garage .
Photograph 14 shows stacks of miscellaneous items and piles of debris under tarps located east
of the garage. The amount of debris in this area has not decreased since previous inspections
. A
rusty shopping cart, a push mower, a dolly, a metal garbage can, lawn tools, funnels, a metal
cabinet, red rubber hose, a gas cylinder, and a rotten wood shelf were observed .

Photograph 15 shows a riding lawnmower, a file cabinet, metal boxes, paint cans, folding chairs,
an air tank, dimensional lumber, hoses, a gas cylinder, storm windows, gasoline cans, and pallets
of debris, that were observed east of the garage .
Photograph 16 shows weed eaters, chrome wheel rings, plastic buckets, wire fencing, storm
windows, black plastic sheeting, folding tray tables, artificial flowers, corrugated sheet metal,
and wood spindles location east of the garage
.
Photograph 17 shows lawn furniture, wooden ladders, aluminum ladders, lattice panels, stacks of
dimensional lumber, and scrap lumber .
Photograph 19 shows stacks of dimensional lumber under tarpaulins, a motor, a sewing machine,
plastic conduit, cardboard boxes, and miscellaneous items stored near the garage
.
Photograph 19 shows stacks of miscellaneous debris south of the garage
. Furniture, lumber, a
fiber drum, a patio umbrella, and numerous boxes and bags of items were observed
.
Photograph 20 shows a broken coffee table, several plastic buckets, a wooden box, a wood
bookshelf, and a black TV stand that has been brought into the site since the last inspection
.
Photograph 21 shows a pile of dimensional lumber, fire wood, and items stacked in front of the
garage.
Photograph 22 shows lawn tools, broom, shovels, eraser hoards, and miscellaneous items stacked
against the garage .
The debris and unusable wastes must be disposed at an Illinois EPA permitted landfill or transfer
station
. Scrap metal not disposed at a landfill can be taken to a scrap metal facility or recycling
center . The used tires must be drained and stored inside or covered to prevent the accumulation
of water . The used or waste tires must be removed to an Illinois EPA registered used tire storage
or used tire disposal facility . Used or waste tires cannot be taken to a landfill or transfer station
for the purpose of disposal
. Loads of more than 20 tires must be hauled by an Illinois EPA
registered used tire transporter .
If local ordinance allow a salvage business at the residence, the scrap metal must be kept
organized, and moved off-site on a regular basis . No burning of waste, including the burning of
insulation off of metal wire, or open dumping of automotive fluids are allowed
.
Mr
. Suttles was previously making progress and had cleaned up approximately fifteen to twenty
percent of this site
; most of his work was concentrated on the front yard and the area between the
homes
. Since the last inspection in May of 2005 no appreciable change has occurred
. Some of
the areas have actually worsened
. There are still approximately 100 cubic yard of off-site
generated waste on the property
. The Suttles have not responded to any of the Illinois EPA
correspondence
. There is also evidence that open burning continues at the site
.
On January 2, 2007, the Illinois EPA inspector called Ron Brockhouse, Waverly Chief of Police
(309/435-2351),
he was aware of several citizen complaints in regards to Mr . Suttles properties
on Elm and Tremont Streets . Mr . Brockhouse referred the inspector to Ernie Cleveland, the
Mayor of Waverly .

On January 2, 2007, the Illinois EPA inspector contacted Ernie Cleveland, Mayor of Waverly
(309/435-9011 & 217/320-5648) . Mr . Cleveland said the city had received numerous complaints
regarding Mr . Suttles' yards . The Mayor said the complaints were being handled by the Zoning
office and to speak with Mrs . Janice Lowder . Mr
. Cleveland mentioned that the complaints have
occurred over the last several years and the City has been working on getting the complaints
resolved
. Mr . Cleveland noted that the Suttles own land around Waverly that is being actively
farmed, however the Suttles are not farming the land themselves
. It appears that only the Suttles
warehouse on Elm Street, and the former and current residence on Tremont Street are the bases
of the complaints .
On January 2, 2007, the Illinois EPA inspector spoke with Mrs
. Lowder, Waverly Zoning Office
(309/435-9618)
. She stated the zoning office is pursuing zoning and nuisance violations against
the Suttles
. The last inspection conducted by the City was held on September 11, 2006 . No
citations have issued and no court dates have been set yet. If a citation is issued the fine starts at
$250 and would be served by the chief of police .
