    ORDER OF THE BOARD (by T.E. Johnson):
    On December 15, 2005, at the parties’ request, the Board extended until March 9, 2006,
    the time period for Biggs Brothers Service Center (Biggs) to appeal a November 3, 2005
    determination of the Illinois Environmental Protection Agency (Agency). At issue is the
    Agency’s rejection of the revised amended high priority corrective action plan for Biggs’ leaking
    underground petroleum storage tank facility located at 2540 Kingshighway, Fairmont City, St.
    Clair County. The Board accepted the petition for hearing on March 16, 2006.
    On January 29, 2007, Biggs filed a motion to dismiss the permit appeal. In the motion,
    Biggs asserts that the issues raised in this appeal have been compromised and settled. Mot. at 1.
    Biggs asks the Board to dismiss the pending permit appeal. The motion is granted. The Board
    hereby dismisses the petition, and closes the docket.
