HEARING OFFICER ORDER
On February 1, 2007, a telephonic status conference was held. Counsel for the
Village of Fox Lake did not appear. In light of the recent decision by the Illinois
Environmental Protection Agency that the petitioner does not need to acquire a permit,
the parties agreed to continue this status to discuss this most recent revelation.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on February 14, 2007, at 3:00 p.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a motion to voluntarily dismiss is filed prior to the next status
conference, the conference will be cancelled without further notice.
