On Monday, January 29, 2007, the Board held its first hearing in this rulemaking

proceeding. The transcript of that hearing is expected to be available on or about Thursday,

February 8, 2007 .

The second hearing will take place as scheduled beginning on Wednesday, February 28,

2007 at 1

:00 PM in the Pollution Control Board Conference Room, inside the north entrance of

the Environmental Protection Agency Building at 1021 N . Grand Ave. E. in Springfield .

After discussing procedural issues at the first hearing, the participants accepted a deadline

of Thursday, February 15, 2007 for the filing of pre-filed testimony for the second hearing .

Consequently, any participant wishing to pre-file testimony for the second hearing in this

proceeding is directed to file it with the Board by Thursday, February 15, 2007 . Because this

deadline falls less than two weeks before the date of the second hearing, the "mailbox rule" at 35

Ill. Adm. Code 101 .300(b)(2) does not apply, and the Board's Clerk must receive these

documents at or before the close of business on Thursday, February 15, 2007

. However, this

pre-filed testimony and other documents may be filed electronically though the Clerk's Office

On-Line (COOL) from the Board's Web site at www.ipcb .state. i1 .us. Participants should direct

any questions about electronic filing through COOL to the Clerk's Office at (312) 814-3629
