This Administrative Citation is issued pursuant to the authority vested
in the Illinois
Environmental Protection Agency by Section 31 .1 of the Illinois Environmental Protection Act, 415
ILCS 5/31 .1 (2004) .
FACTS
1 .
That Donald Langley and Perry W inebrinner are the present owners and Bret Slater
was the operator(collectively "Respondents") of a facility located at 320 Galena Street, Lincoln,
Logan County, Illinois . The property is commonly known to the Illinois Environmental Protection
Agency as Lincoln/Langley-Winebrinner .
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No
. 1070355050 .
3.
That Respondents have owned/operated said facility at all times pertinent hereto .
4 .
That on December 15, 2006, Paul Eisenbrandt of the Illinois Environmental
Protection Agency's Springfield Regional Office inspected the above-described facility . A copy of

his inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.
VIOLATIONS
Based upon direct observations made by Paul Eisenbrandt during the course of his
December 15, 2006 inspection of the above-named facility, the Illinois Environmental Protection
Agency has determined that Respondents have violated the Illinois Environmental Protection Act
(hereinafter, the "Act") as follows
:
(1)
That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2004).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2004), Respondents are
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500
.00) for each of the
violations identified above, for a total of
One Thousand Five Hundred Dollars ($ 1,500
.00). If
Respondents elect not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than
March 1, 2007,
unless otherwise provided by
order of the Illinois Pollution Control Board
.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31
.1 of the Act, 415 ILCS 5/31
.1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board
. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500
.00) statutory civil penalty for each

violation .
Pursuant to Section 31 .1(d)(1) of the Act, 415 ILCS 5/31
.1(d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above .
When payment is made, Respondent's check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276 . Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment .
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received
. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31 .1 of the Act, 415 ILCS 5/31/1 (2004)
. If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276 . Section 31 .1 of the Act provides that any Petition for Review shall be filed within
thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondents .

INSPECTION DATE : December 15, 2006
The purpose of this memorandum is to serve as the Narrative Inspection Report Document of a
December 15, 2006 complaint investigation of the above referenced site . A July 2005 complaint
alleged the property was being used as an open dump for old cars and wastes ; oil and other
chemicals were spilled on the ground ; and that there were old fuel tanks stored under the lot . The
initial compliant investigation was conducted on August 29, 2005, and several apparent
violations of the Environmental Protection Act were observed . The September 15, 2005
Administrative Citation Warning Notice imposed an October 15, 2005 compliance deadline . A
second investigation was conducted on October 20, 2005 and an extension of the compliance
deadline was given to until November 15, 2005
. The third inspection took place on March 20,
2006. This forth inspection took place from about 10 :10 am to 11
:00 am, and thirteen (13)
digital photographs were taken. The weather was sunny and approximately 45 °F
with a 5 mph
wind from the northwest . No one was interviewed during the inspection .
Photograph 1 shows an overview of the site from Sangamon and Galena Streets . Approximately
eighty-five percent of the waste has been cleaned up . Most of the remedial activities occurred
prior to the March 20, 2006 inspection . Since the March 20, 2006 inspection, approximately
twenty five used tires have been removed from the site
. All of the miscellaneous waste observed
in the southwest corner of the concrete pad has remained unchanged
. The Illinois EPA estimated
approximately six' yards of off-site generated waste are still on the property
.
Photograph 2 shows the north entrance to the facility. A gate made of cyclone fencing is
stretched across the open to secure the site . The cyclone fencing is simply tied with wire on each
end.
Photograph 3 shows the east gate (main entrance) to the facility . The east gate was loosely
chained and padlocked
. An opening in the fence was observed to the left of the gate . It appears
the fencing and gates adequately deter vehicle trespass
. A posted sign to the north of the gate
reads "Private Property - No Trespassing
."
Photograph 4 shows a red Pontiac Grand Am SE V6 without license plates
. The Pontiac vehicle

identification number (VIN) was 1G2NE12E8XM743681 GM
. The vehicle was on site during
the March 20, 2006 inspection . The vehicle appears to be operable as it has been moved since
the last inspection .
Photograph 5 shows five sections of metal tower, a trailer frame, and a few pieces of scrap metal
.
The rusty trailer frame did not have a license plate . A Pontiac grill, a sheet of corrugated steel,
and two metal studs were among the scrap metal .
Photograph 6 shows a light blue Ford Taurus GL sedan without wheels (tires or rims) resting on
cinder blocks
. The inoperable Ford had a broken windshield and was observed in the same
condition and location during all of the previous inspections
. The vehicle had no visible VIN
number and had no license plates
. A green military style vessel (labeled "Water HHC 1/126")
was observed under the front driver side wheel well
. The fluid in the half full vessel had a trace
hydrocarbon odor .
Photographs 7 through 13 shows a 30 foot by 10 ft by 3 foot high waste pile located on a
concrete pad in the backside of the site
. The waste pile has not noticeably changed since the last
inspection in March .
Photograph 7 shows an empty blue and white partially crushed 30 gallon drum, three truck
toppers (full of debris), used automotive parts, a black and yellow tool box, a broken Sanyo TV,
small diameter tire, electronic circuit boards, a broken snow shovel, a wheel barrow, wire mesh,
landscape waste, and charred dimensional lumber observed in the waste pile .
Photograph 8 shows a rusty red art deco kitchen table, galvanized pipe, an empty black and white
22 gallon drum, clothing, a broken fishing pole, scrap metal, a green garden hose, a crushed blue
and orange drum, aluminum soda cans, rusty aerosol cans, an interior vehicle door panel,
fragments of broken plastic, shredded Styrofoam, scrap diamond plate, rusty coffee cans,
automotive hoses, disintegrating cardboard, and dimensional lumber were some of the weathered
waste observed .
Photograph 9 shows landscape waste, rotting wood pallets, refrigerator shelves, weathered OSB
board, and fiberglass vehicle body parts .
Photograph 10 shows broken plastic buckets, dog food cans, motor oil containers, plastic soda
bottles, metal vehicle body parts, and rusty cans .
Photograph 11 shows a vehicle gasoline tank, cardboard boxes, a brown garbage can (full of
stagnant water, broken glass, rotting leaves, and an aerosol can) tattered plastic sheeting, cloth
towels, cardboard and Styrofoam food packaging, a garden hose reel, a metal pan, a broken lawn
mower bag, and used air filters .
Photograph 12 shows a roll of metal reinforcing mesh, mangled cyclone fencing, a bicycle tire,
vehicle floor mats, a dryer lint screen, black plastic sheeting, PVC drain pipe, black rubber
sheeting, wood veneer, a twin size mattress coil, a crushed five gallon metal container, and white
garden edge fencing among other miscellaneous waste that were observed in the debris pile .

Photograph 13 shows several small diameter used tires (bicycle, wheel barrow, and trailer?)
among other waste that were observed in the debris pile .
It should be noted that there were no apparent signs of oil or gasoline spills
.
The Illinois EPA inspector spoke with Mr . Donald Langley on March 22, 2006
. Mr. Langley, at
that time, had stated he was planning to remove the used tires within a few days and remove the
pile of mixed debris when the weather broke . He was probably going to haul the waste to
Clinton . Mr
. Langley stated he had needed two weeks to get the rest of the waste hauled off the
site. Based on the amount of work that Mr
. Langley had already completed, the Illinois EPA
inspector recommended giving Mr
. Langley a final two week extension as he had requested in
March of 2006 . Mr
. Langley removed the used tires but failed to remove the rest of the waste as
of December 15, 2006
. The Administrative Citation Warning Notice (ACWN), dated September
15, 2005 required all waste to be removed by October 15, 2005 . Mr. Langley, Mr . Winebrinner,
and Mr
. Slater have had fourteen months to comply with the corrective actions listed in the
ACWN
. An Administrative Citation may be issued for the violations of the Section 21(p) of the
Illinois Environmental Protection Act and failing to complete the clean up requirements .
The apparent violations noted as a result of this forth inspection are checked on the Open Dump
Inspection Checklist attached to this narrative . A site sketch and digital photographs accompany
this narrative .
