This Notice of Public Information under Section 7 .2(b) of the Illinois Environmental Protection
Act (Act), 415 ILCS 5/7.2(b) (2006), explains why it was necessary for the Board to extend until
October 30, 2006 the deadline for adoption and filing of rules in the following identical in
substance rulemaking : Wastewater Pretreatment Update, USEPA Amendments (July 1, 2005
through December 31, 2005), R06-13.
The public comment period was scheduled to close October 2, 2006, a minimum of 45 days after
Illinois Register publication of the proposal on August 18, 2006
. The Board, in its August 4,
2006 opinion and order proposing these amendments for public comment, explained that it
would extend the deadline in this rulemaking
. In its explanation for the delay, the Board noted
that the current heavy demands on available staff time and accumulated delays in other identical-
in-substance rulemaking proceedings resulted in the need for additional time to complete the
current rulemaking

December 31, 2005), R06-17; and
RCRA Subtitle C Update, USEPA Regulations (July 1, 2005
through December 31, 2005), R06-18 (consolidated) and SDWA Update, USEPA Regulations
(July 1, 2005 through December 31, 2005), R06-15.)
The original due date for filing this rulemaking with the Secretary of State's Index department
was October 13, 2006 (one year after the earliest federal action that is included in the identical-
in-substance update). The Board calculated that the earliest date by which it can complete this
proceeding, and file the adopted amendments with the Office of the Secretary of State is October
30, 2006 .
