HEARING OFFICER ORDER
On January 18, 2007, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it anticipates that it will file a motion to
consolidate the above-captioned matter with a related PCB 07-48 matter within the next 2 days.
To that end, it was agreed that petitioner be given an extension of time to file its response to
respondent’s motion for summary judgment. The petitioner’s response is now due on or before
March 22, 2007. Another extension for petitioner’s response will possibly be revisited at the
next telephonic status conference.
The petitioner represented that it will file an open waiver of the statutory decision
deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference on March 22, 2007, at 11:00 a.m. The status conference must be initiated by the
petitioner, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
