collection and pretreatment system consisting of two 5,000-gallon
holding tanks
; a three stage treatment unit consisting of a 500-
gallon oil/water separator, a 375-gallon pH adjustment chamber
with sulfuric acid and ferric sulfate addition, and a 375-gallon
neutralization system with caustic acid addition
; a rotary vacuum
filter utilizing diatomaceous earth as a filter aid, and all pipes,
pumps, appurtenances necessary for the collection and
pretreatment of truck cleaning wastewater.

Section 11-10 of the Property Tax Code, 35 ILCS 200/11-10 (2004), defines
"pollution control facilities" as
:
"any system, method, construction, device or appliance appurtenant
thereto or any portion of any building or equipment, that is designed,
constructed, installed or operated for the primary purpose of
: (a)
eliminating, preventing, or reducing air or water pollution
. . .or (b)
treating, pretreating, modifying or disposing of any potential solid, liquid
or gaseous pollutant which if released without treatment, pretreatment
modification or disposal might be harmful, detrimental or offensive to
human, plant or animal life, or to property
."

Pollution control facilities are entitled to preferential tax treatment, 35 ILCS
200/11-5 .

Based on the information in the application and the purpose of the facilities, it is
the Illinois EPA's engineering judgment that the described facilities may be
considered "pollution control facilities," pursuant to 35 111 . Adm

.200(a), with the primary purpose of eliminating, preventing, or reducing
water pollution, or as otherwise provided in 35 III . Adm
. Code 125 .200, and are
eligible for tax certification from the Board

associated with the cleaning of tanks used to transport herbicides . First rinse water will be
hauled off-site for incineration . All

to Section 301, 3D6, or 307 of the Federal Clean Water Act of 1977 . The guidelines established for Transportation Cleaning
Point Source Category (40 CFR Part 432 Subpart A - Tank Trucks and Intermodal Tank Containers Transporting Chemical
and Petroleum Cargos and Subpart D - Tanks Transporting Food Grade Cargos) limit the pollutants from facility as follows .-

. All sampling and testing shall be in accordance with 40 CFR 136 or other Agency approved methods .

. The permittee shall maintain a list of cargos of all the trucks that are internally cleaned at the facility, and the date on which
the cleaning took place
. Material Safety Data Sheets for the cargos of all the trucks that are internally cleaned shall be
retained on site, and made available to the Agency upon request.

. Monitoring results and cargo lists shall be submitted on or before February 1st and August 1st each year for the duration
of the permit to the Village of Morton and following addresses

Note: A summary of monitoring results can be sent in spread sheet format to Village of Morton, Peoria office, and USEPA,
Lab data shall accompany results sent to Springfield office .
E . ADDITIONAL MONITORING REQUIREMENTS
The permittee shall sample the discharge once per year for priority pollutants listed in 40 CFR 122 Appendix D, Table II under
Acid Compounds and Case/Neutral headings . Samples shall be collected from a discharge which contains wastewater from
the cleaning of a truck containing a fatty acids product ; or from a truck containing glues
: or from a truck containing lube oils
and additives .
The permittee shall sample the discharge once per year for priority pollutants listed in 40 CFR 122 Appendix D, Table II under
volatile$ heading . Samples shall be collected from a discharge which contains wastewater from the cleaning of a truck
containing a toluene and xylenes product ; or from a truck containing isopropyl alcohol
; or from a truck containing latexes and
adhesives
.
Tests shall be done as described in Part B, with type of wastewater cleaned specified
. Results shall be submitted to
addresses In Part D along with February 1st report.

: Within 90 days of issuance of permit the permittee shall be required to redevelop the Heel Minimization
Program . The new plan shall be referred to as the Pollution Management Plan and shall follow guidelines as described in 40 CF
442 .15(b)(5) section (i) through (x) .
The Pollution Management Plan shall be submitted to the Agency within 90 days of issue da
of this permit to addresses listed In Special Condition 7 .
The permittee may be notified by the Agency at any time that the Plan does not meet the requirements of this permit . After such
notification the permittee, within an Agency specified allotted time, shall make changes to the Plan and shall submit a written
certification stating that the requested changes have been made
.
SPECIAL CONDITION 10 : The Permittee shall reevaluate its average BOO concentration and reapply for a supplemental permit
with a new design average population equivalent based on the estimated/calculated average BOD concentration .
