Dear Chairman Girard :

Thank you for your November 21, 2006 letter requesting the Department of Commerce

and Economic Opportunity ("Department") to conduct an economic impact study concerning the

National Solid Wastes Management Association's (NSWMA) proposal to amend the Board's

solid waste disposal regulations .

The Department has reviewed the Board's request for an Economic Impact Study for

NSWMA's proposal . Based on this review, and in light of continued fiscal constraints, the De-

partment has decided not to conduct a study of the economic impact of the above referenced site-

specific rulemaking proposal .
