CORRECTEDHEARING OFFICER ORDER
This corrected order differs from the original order dated January 8, 2007 only by making
corrections to the caption and not by changing the text .
In an order dated November 17, 2006, the hearing officer issued an order directing any
participant to submit all testimony and any related exhibits on or before Monday, January 15,
2007, for the first hearing in this proceeding
. The same order directed the Illinois Chapter of the
National Solid Waste Management Association (NSWMA) to address in writing on or before
Monday, January 15, 2007, the deficiencies in NSWMA's rulemaking petition identified by the
Board in its August 17, 2006 order
. The November 17, 2006, order also provided that the
"mailbox rule" at 35 Ill . Adm. Code 101 .300(b)(2) does not apply to these filings .
In setting that deadline on November 17, 2006, the hearing officer did not recognize that
Monday, January 15, 2007, is a state holiday observing Martin Luther King Day
. By operation
of the Board's procedural rules regarding computation of time, these filings are due on or before
Tuesday, January 16, 2007
. 35 Ill . Adm. Code 101 .300(a) . As before, the "mailbox rule" at 35
Ill . Adm. Code 101 .300(b)(2) does not apply to these filings . The Clerk must receive these
documents at or before the close of business on Tuesday, January 16, 2007
