HEARING OFFICER ORDER
On October 23, 2006, the Illinois Environmental Protection Agency (Agency) filed a
proposal under the general rulemaking provisions of Section 27 of the Environmental Protection
Act (415 ILCS 5/27 (2004))
. The proposal seeks to update existing water quality standards for
sulfate and total dissolved solids, by amending 35 Ill. Adm
. Code Parts 302, 309, 405, 406, and
407 of the Board's water and mine-related pollution rules
.
The Board will hold at least two hearings in this matter . Both hearings will be conducted
to allow the Agency and all other interested parties the opportunity to present testimony on the
proposed rules . The order of the first hearing will be :
1 .
Opening statements ;
2.
Testimony by the Agency ; and
3.
Questions of the Agency.
The order of the second hearing will be determined at a later date .
The "Notice List" is the list of interested persons who wish to receive only the Board's
opinions and orders and hearing officer orders in this proceeding . The "Service List" is persons
who wish to participate in the proceeding and receive all prefiled testimony and to be participants
of record . To be placed on either the "Notice List" or the "Service List" contact the hearing
officer at the address or phone number below or you may also sign up at www.ipcb .state.il_us .
In the Board's order of November 16, 2006, accepting the proposal, the Board noted
deficiencies in the proposal . Specifically, the Board found that the proposal did not include the
required "synopsis of all testimony to be presented by the proponent at hearing ." 35 Ill. Adm.
Code 102.202(c). To cure this deficiency, the Agency's testimony supporting the proposal must
be prefiled by February 5, 2007 . That testimony will be available either on the Board's web page
at www .ipeb.state.il.u s or by contacting the hearing officer . The prefiling deadline for the second
hearing will be established at the first hearing .
