HEARING OFFICER ORDER

On February 16, 2006, the Board granted complainant’s motion to stay this proceeding

until such time as the Board orders otherwise. As the parties last reported, this appeal cannot

proceed without the resolution of a related docket, People v. Saint-Gobain Containers, Inc.,

PCB 03-22. On January 2, 2007, the People filed a status report in PCB 03-22 stating that

settlement discussions were on-going, although it did not appear that an agreement was

imminent. If there are any developments in this appeal of which Board should be aware, the

petitioner is directed to file a status report.

The parties are directed to participate in a telephone status conference with the hearing

officer at 9:15 a.m. on June 25, 2007. The status conference shall be initiated by the petitioner.

Petitioner filed an open waiver of the decision deadline in this matter.
