HEARING OFFICER ORDER
On December 6, 2006, the parties participated in a telephone status conference
with the hearing officer. The parties agree that the response to the second motion for
summary judgment is due December 14, 2006, and the reply is due December 28, 2006.
A hearing will be set for January 8 through January 11, 2007.
The parties are directed to participate in a telephone status conference with the
hearing officer at 1:00 p.m. on January 3, 2007. The status conference shall be initiated
by the petitioner.
The decision deadline for this case is currently March 1, 2007. PDC may file an
additional deadline waiver to extend the post-hearing briefing schedule.
