Based on a telephone discussion of November 20, 2006 between Sidney Margolis,

Petitioner's attorney, and Melanie A . Jarvis, Respondent's attorney, developments are ongoing

between the parties that could resolve this Appeal shortly . Therefore, Petitioner hereby waives

the statutory decision deadline for an additional forty (40) days . Petitioner previously waived
