HEARING OFFICER ORDER
On November 27, 2006, petitioner participated in a telephone status conference
with the hearing officer. Respondent did not appear. Petitioner has been waiting for
respondent’s comments on the proposed permit provisions for several months. Petitioner
continues to contact respondent, but cannot get any updates regarding the status of the
review. By the next status conference, respondent’s attorney is directed to provide
petitioner with new information regarding the status of the technical unit’s review,
including a completion date. If petitioner cannot get any further information from
respondent, petitioner may request that this matter be set for hearing.
The parties are directed to participate in a telephone status conference with the
hearing officer at 9:30 a.m. on December 19, 2006. The status conference shall be
initiated by the petitioner.
Petitioner filed an open waiver of the statutory decision deadline.
