HEARING OFFICER ORDER
On November 28, 2006, the parties participated in a telephone status conference with the
hearing officer. The parties are discussing a new appeal for this site, PCB 07-43, that the Board
is expected to accept for hearing on December 7, 2006. Petitioners may proceed to hearing
immediately on the new docket, which would render this appeal moot. The hearing officer does
not yet know the decision deadline for PCB 07-43, so petitioners agreed to address any waiver
issues for both dockets at the next status conference.
The parties are directed to participate in a telephone status conference with the hearing
officer at 3:30 p.m. on December 18, 2006. The status conference shall be initiated by the
petitioners.
The decision deadline for this case is currently March 15, 2007.
