    ORDER OF THE BOARD (by G.T. Girard):
    On November 13, 2006, the parties timely filed a joint notice to extend the 35-day period
    within which Knapp Oil Company, Inc. (Knapp Oil) may appeal an October 5, 2006
    determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2004); 35 Ill. Adm. Code 105.402, 105.406. The Agency rejected Knapp Oil’s High
    Priority Corrective Action Plan Budget, but rejected the associated budget on the grounds that
    the budget as submitted did not include amendments requested by Agency letter of July 17,
    2006. The leaking underground petroleum storage tank facility is located at 1117 East Fifth
    Road, Metropolis, Massac County.
    The Board extends the appeal period until February 12, 2007 (125 days after the October
    10, 2006 petition receipt date), as the parties request.

    Adm. Code 105.406. If Knapp Oil Chevrolet, Inc. fails to file an appeal on or before that date,
    the Board will dismiss this case and close the docket.
