HEARING OFFICER ORDER
On November 16, 2006, all parties participated in a telephonic status conference
with the hearing officer. The complainant represented that a revised penalty demand in
light of the inability to pay documents has been agreed to and will draft a stipulation and
proposal for settlement (stipulation) for review. The respondent has requested a no
admission of liability in the stipulation. To that end, respondent’s answer, if needed, is
now due to be filed on or before February 9, 2007.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on January 25, 2007, at 10:15 a.m. The
telephonic status conference must be initiated by the complainant, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a stipulation is filed prior to the next status conference, the
conference will be cancelled without further notice.
