HEARING OFFICER ORDER
On November 9, 2006, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it has received and reviewed the expected
comments from the Illinois Environmental Protection Agency (Agency). The petitioner
represented that it appears they are close to agreement on the issues. In an attempt to streamline
the hearing in this matter, the petitioner will forward the expected testimony and information to
the Agency for its review. It is anticipated that a hearing date will be discussed at the next status
conference.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 25, 2007, at 11:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discus the status of
the matter and their readiness for hearing.
