HEARING OFFICER ORDER
On November 1, 2006, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that settlement discussions are going well and the
above-captioned matter may be resolved prior to the next status conference. By agreement, the
respondent’s record is now due to be filed on or before December 8, 2006. Finally, the petitioner
represented that it will file a 40-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference on November 20, 2006, at 10:30 a.m. The status conference must be initiated by the
petitioner, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a motion to voluntarily dismiss the above-captioned
matter prior to the next status conference, the conference will be cancelled without further
notice.
