HEARING OFFICER ORDER
On October 19, 2006, all parties participated in a telephonic status conference
with the hearing officer. The respondent represented that the discussions have been
ongoing and that it appears that one issue remains to be addressed in the draft permit
appeal. It is anticipated that whether a resolution in this matter will be achieved will be
confirmed prior to the next telephonic status conference. The petitioner represented that
it will file a 40-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference on November 16, 2006, at 10:45 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
