HEARING OFFICER ORDER

In an order dated September 8, 2006, the hearing officer issued an order allowing any

participant to file a response to the post-hearing comments filed either by the Agency or by

NORA on or before Monday, October 9, 2006, which is the first business day after the 30th day

from the date of that order

. That order also provided that the "mailbox rule" at 35 Ill . Adm.

Code 101

.300(b)(2) does not apply to the filing of any response to the post-hearing comments

.

In setting that date on September 8, 2006, the hearing officer did not recognize that

Monday, October 9, 2006, is a state holiday observing Columbus Day . By operation of the

Board's procedural rules regarding computation of time, any response to the post-hearing

comments is due on or before Tuesday, October 10, 2006 . 35 Ill. Adm. Code 101 .300(a). As

before, the "mailbox rule" at 35 Ill. Adm . Code 101

.300(b)(2) does not apply to the filing of any

response to the post-hearing comments

. The Clerk must receive these documents on or before

the close of business on Tuesday, October 10, 2006

. Comments and other documents in this
