HEARING OFFICER ORDER
On October 2, 2006, petitioner participated in a telephone status conference with the
hearing officer. Respondent did not appear. Petitioner continues to wait for respondent to
propose permit language that applies to the groundwater monitoring provisions at issue in this
case. Respondent’s attorney is directed to find out how much longer this may take.
The parties are directed to participate in a telephonic status conference with the hearing
officer at 10:30 a.m. on November 2, 2006. The telephone status conference will be initiated by
the petitioner.
Petitioner filed an open waiver of the decision deadline in this case.
