As you know, an underground storage tank owner or operator may appeal the final
decision of the Illinois Environmental Protection Agency (IEPA) to the Illinois Pollution Control
Board (IPCB) pursuant to Section 57
.8(1) and Section 40 of the Illinois Environmental Protection
Act (Act) by filing a Petition for a hearing with in thirty five days after the date of issuance of the
final decision of August 24, 2006
.
As you also know and as our client is requesting, this thirty five (35) day period may be
extended for a period of time not to exceed ninety (90) days by written notice from the owner or
operator and the IEPA within the initial thirty five day appeal period
. In that regard, please
accept this correspondence as our written request which includes a statement of the date of the
final decision was received (August 24, 2006) along with a copy of the decision
.
Finally, we are hereby requesting that both the IPCB as well as the [EPA contact the
undersigned to discuss the filing of the extension as well as the filing of an appeal

The Illinois Environmental Protection Agency has completed the review of your application for
payment from the Underground Storage Tank Fund for the above-referenced Leaking UST
incident pursuant to Section 57.8(a) of the Illinois Environmental Protection Act (Act), and

ill. Adm. Code 732, Subpart F . This information is dated March 15, 2006
and was received by
the Agency on May 1,
2006 . The application for payment covers the period from March 17,
2000
to May 26, 2000
. The amount requested is $34,355
.00 .
The deductible amount to be assessed on this claim is $15,000
.00, which is being deducted from
this payment.
On May 1, 2006, the Agency received your complete application for payment for this claim. As.
a result of the Agency's review of this application for payment, a voucher for $19,355 .00 will he
prepared for submission to the Comptroller's Office for payment as funds become available
based upon the date the Agency received your complete request for payment of this application
for payment Subsequent applications for payment that have been/are submitted will be
processed based upon the date complete subsequent application for payment requests are
received by the Agency. This constitutes the Agency's final action with regard to the above
