    ORDER OF THE BOARD (by G.T. Girard):
     
    On September 18, 2006, the parties timely filed a joint notice to extend the 35-day period
    within which Frey Enterprises, Inc. (Frey) may appeal an August 16, 2006 determination
    (received by Frey August 18, 2006) of the Illinois Environmental Protection Agency (Agency)
    concerning an application covering the time period November 1, 2005 to February 25, 2006.

    415 ILCS 5/40(a)(1) (2004); 35 Ill. Adm. Code 105.402, 105.406. The Agency denied payment
    of certain costs of corrective action for Frey’s leaking underground petroleum storage tank
    facility located at 308 North Main, Dupo, St. Clair County.
     
    The Board extends the appeal period until December 21, 2006, as the parties request.

    before that date, the Board will dismiss this case and close the docket.
