HEARING OFFICER ORDER

On September 25, 2006, the petitioner informed the hearing officer that it is awaiting the

decision of the respondent regarding the resubmitted costs and receipt of the proceeds. The

petitioner represented that it will file a six month waiver of the statutory decision deadline.

The parties are directed to participate in a telephonic status conference on

December 21, 2006, at 12:00 p.m. The status conference must be initiated by the petitioner, but

each party is nonetheless responsible for its own appearance. At the status conference, the

parties must be prepared to discuss the status of the above-captioned matter and their readiness

for hearing. If, however, motion to voluntarily dismiss is filed prior to the next status

conference, the conference will be cancelled without further order.
