HEARING OFFICER ORDER
On September 21, 2006, all parties participated in a telephonic status conference
with the hearing officer. The petitioner requested that the respondent supplement the
record with some additional documents. The respondent represented that it will
supplement the record to the extent that it could. The petitioner represented that it may
file some discovery requests.
Further, the respondent represented that it may file a motion for leave to reply to
petitioner’s response to its motion for summary judgment. The petitioner represented
that it may file its own motion for summary judgment as well. Finally, the petitioner
represented that it will file a 90-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference on November 16, 2006, at 11:30 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
