HEARING OFFICER ORDER
A telephonic status conference was scheduled for September 14, 2006. The
petitioner informed the hearing officer that it would be unable to appear due to a
scheduling conflict. On September 20, 2006, the petitioner informed the hearing officer
that it will file a 90-day waiver of the statutory decision deadline. The status conference
has been rescheduled to the date and time noted below.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on November 2, 2006, at 9:15 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a motion to dismiss is filed prior to the next status conference,
IT IS SO ORDERED.
