HEARING OFFICER ORDER
On September 14, 2006, a telephonic status conference was held. Respondent Illinois
Environmental Protection Agency did not appear due to a scheduling conflict. The petitioner
represented that the parties now have an agreed settlement document but that two issues, permit
application form and financial assurance, still need to be addressed. Those issues, however,
appear to be nearly resolved.
The petitioner represented again that it will not file a response to County of Lake’s
motion for joinder of Village of Lake Villa and Village of Fox Lake, filed December 14, 2005.
It was agreed that responses to all other outstanding motions are now due on or before
November 16, 2006.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 2, 2006, at 11:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
