HEARING OFFICER ORDER
On June 29, 2006, complainant filed an amended complaint along with a motion for leave
to file. Respondent did not object. Accordingly, the motion for leave to file is granted, and the
amended complaint is accepted for hearing.
On September 11, 2006, the parties participated in a telephone status conference with the
hearing officer. Complainant is working with the Illinois Environmental Protection Agency to
approve a sampling plan. Once approved, respondent will conduct sampling, and settlement
discussions will resume based on the results.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on December 11, 2006. The status conference shall be initiated by the
complainant.
