HEARING OFFICER ORDER
On September 7, 2006, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it continues to have internal discussions . It also
represented that it is monitoring a related matter now with the United States Environmental
Protection Agency that may affect the above-captioned matter .
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 2, 2006, at 2 :00 p .m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance
. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing
.
