FACTS
1 .
That Respondent, Veolia ES Orchard Hills Landfill, Inc
., is the present operator of a
facility located in the County of Ogle, State of Illinois
.
2.
That said facility is operated as a sanitary landfill, operating under Illinois Environmental
Protection Agency Operating Permit No
. 1996-135-LF, and designated with Site Code
No. 1410175005
.
3 .
That Respondent has owned or operated said facility at all times pertinent hereto
.
4 .
That on June 30, 2006, said facility was known as Onyx Orchard Hills Landfill, Inc
. and
changed its name on July 1, 2006 to Veolia ES Orchard Hills Landfill, Inc
.
5.
That on June 30, 2006, Joy K
. Bliton of the Ogle County Solid Waste Management

 
Department, inspected the above-described landfill facility . A copy of the inspection
report setting forth the results of such inspection is attached hereto and made a part
hereof.
6.
That on previous occasions, Joy K. Bliton of the Ogle County Solid Waste Management
Department has reminded the operation managers of the above described landfill facility
that they were using construction and demolition debris incorrectly (Inspections on May
30, 2006 and January 24, 2005)
. Two inspection report narratives and one fax
transmission to Onyx Orchard Hills Landfill of the definitions of general construction and
demolition debris and clean construction or demolition debris from Section 3 .160 of the
Illinois Environmental Protection Act 415 ILCS 5/3 .160 are included in Attachment A.
VIOLATIONS
On the basis of direct observation by Joy K . Bliton, the County of Ogle has determined
that Respondent was conducting a sanitary landfill operation at the above-described facility,
which is required to have a permit pursuant to 415 ILCS 5/21(d), in a manner which resulted in
the following conditions:
A.
That on June 30, 2006, an on-site inspection of said sanitary landfill facility and
review of Illinois Environmental Protection Agency files and records of said
facility disclosed the following :
1 .
Uncovered refuse remaining from a previous operating day, in
violation of 415 ILCS 5121(o)(5); and
2.
Failure to collect and contain litter from the site by the end of each
operating day, in violation of 415 ILCS 5/21(o)(12) .

 
CIVIL PENALTY
Pursuant to 415 ILCS 5/42(b)(4), Respondent herein is subject to a civil penalty of Five
Hundred Dollars ($500.00)
for each violation specified above in Paragraph A, for a total of
1000.00 Dollars ($1,000 .00). Additionally, should Respondent elect to petition the Illinois
Pollution Control Board under the review process described herein below, and if there is a
finding of the violations alleged herein, after an adjudicatory hearing, Respondent shall be
assessed the associated hearing costs incurred by Ogle County and the Illinois Pollution Control
Board, in addition to the Five Hundred Dollar ($500 .00) statutory penalty for each finding of
violation . If you acknowledge the violations cited hereinabove, the civil penalty specified above
shall be due and payable no later than 35 days from the date of service hereof
. If you do not
petition the Illinois Pollution Control Board for review of this Administrative Citation within
thirty-five (35) days of service hereof or if you elect to contest this Administrative Citation, any
judgment rendered against you shall specify the due date of the statutory civil penalty and any
costs assessed against you .
When payment is made, your check should be made payable to Ogle County Solid Waste
Fund and mailed to the Ogle County Treasurer, Ogle County Courthouse, P
.O . Box 40, Oregon,
IL 61061 .
If any civil penalty, by reason of acknowledgment, default or finding after adjudicatory
hearing, is not paid when due, the Illinois Environmental Protection Agency shall take into
consideration such failure to pay during any permit review process upon your application for a
new permit or for renewal of an existing permit . If any civil penalty imposed by the Illinois
Pollution Control Board is not paid within the time prescribed in the order, interest on such
penalty will be assessed for the period from the date payment is due until the date payment is

 
received. Furthermore, if payment is not received when due, the Ogle County State's Attorney
shall be requested to initiate proceedings in Circuit Court to collect said civil penalty . In
addition to the previously assessed civil penalty, interest, and hearing costs of Ogle County and
the Illinois Pollution Control Board, if any, the Ogle County State's Attorney will seek to
recover their costs of litigation .
PROCEDURE FOR CONTESTING ADMINISTRATIVE CITATION
You have the right to contest this Administrative Citation (see 415 ILCS 5/31 .1). If you
elect to contest this Administrative Citation, you must file a Petition for Review with the Clerk
of the Illinois Pollution Control Board . A copy of the Petition for Review should be filed with
the Ogle County State's Attorney. Such Petition for Review must be filed within thirty-five (35)
days of the date of service of this Administrative Citation, or a default judgment shall be entered
by the Pollution Control Board . The Petition for Review may be filed with the Clerk of the
Illinois Pollution Control Board at the State of Illinois Center, 100 West Randolph, Suite 11-500,
Chicago, Illinois 60601 ; and, a copy of said Petition for Review filed with the Ogle County
State's Attorney at the Ogle County Courthouse, 106 S

General Remarks
I arrived at the Veolia ES Orchard Hills Landfill, Inc . at 10:14 am. I walked up to the
scale house. Cindy said that Chris Peters, the General Manager, was not in . She said I could
proceed with my inspection.
I drove out to the working face which was in Phase V . They were hauling dirt from the
future Phase VI to the north side of Phase IV for final capping
. I noted that a large area north and
south of the access road was covered with general construction and demolition debris
. This area
could not be considered a road as the debris was on areas north and south of the access road nor
was it covered with aggregate as is required of road base materials in the operating permit No
.
1996-135-LF, modification #37, Section, 28(a) . Construction and demolition debris is not
permitted to be used as intermediate cover either . In addition, general construction and
demolition waste may not be used for ADCM
. Therefore, this appeared to be a violation of the
operating permit, IPCB Regulations and Illinois Environmental Protection Act (ACT) .
Daniel Bunk, an equipment operator, arrived and he accompanied me on the inspection
.
We discussed the general construction and demolition debris being used . I explained that they
cannot use it in the manner that they have been doing (see above paragraph) .
We drove to the north side of the landfill . He explained the work that they are doing on
the gas piping system . We looked at Phase IV that they will be capping soon .
We then drove south along the perimeter road to Phase V . We walked on top of the west
end of Phase V
. This large area is also covered with general construction and demolition debris
which again does not meet the requirements of the ACT, regulations or operating permit . There
appears to be at least 6 acres on site that is covered with general construction and demolition
debris. I discussed this concern with Daniel Bunk .
I drove back to the scale house and left the site at 11 :45 a.m.

Cindy, the scale house operator, called Chris Peters, the General Manager
. Chris met me and we
drove to the landfill.
Chris pointed out the new litter fences added to the slope of Phase II
. We drove over to
the working face which is in Phase V
. Chris and I discussed the pile of general construction and
demolition debris
. They have been using it for road base and for Alternative Daily Cover
Material (ADCM)
. Because this pile is not clean construction and demolition debris, it can only
be used for road base materials and not ADCM
. The general construction and demolition pile
contains primarily wood, but also pieces of metal, fabric, plastic, etc
. Any materials not included
in the definition of General Construction or Demolition Debris, shall be considered as waste and
is not to be included in road base material nor as ADCM
.
According to Section 3
.160 of the Illinois Environmental Protection Act 415 ILCS,
5/3
.160), general construction and demolition debris means non-hazardous, uncontaminated
materials resulting from the construction, remodeling, repair, and demolition of utilities,
structures, and roads, limited to the following
: bricks, concrete, and other masonry materials
;
soil
; rock, wood, including non-hazardous painted, treated, and coated wood and wood products
;
wall coverings; plaster, drywall; plumbing fixtures
; non-asbestos insulation
; roofing shingles and
other roof coverings ; reclaimed asphalt pavement
; glass
; plastics that are not sealed in a manner
that conceals waste
; electrical wiring and components containing no hazardous substances
; and
piping or metals incidental to any of those materials .
General construction or demolition debris does not include uncontaminated soil
generated during construction, remodeling, repair, and demolition of utilities, structures, and
road provided the uncontaminated soil is not commingled with any general construction or
demolition debris or other waste
.
Section 11.6 (j) of the operating permit 1996-135-LF, modification No
. 37, states that

clean construction and demolition debris as defined in Section 3
.160(b) of the Act, may be used
as ADCM
. Clean construction or demolition debris means uncontaminated broken concrete
without protruding metal bars, bricks, rock, stone, reclaimed asphalt pavement, or soil generated
from construction or demolition activities .
Clean construction or demolition debris does not include uncontaminated soil generated
during construction, remodeling, repair, and demolition of utilities, structures, and roads
provided the uncontaminated soil is not commingled with any clean construction or demolition
debris or other waste.
Section 1I.6(j)
goes on to state that only material that can be placed without leaving
unacceptably large voids or open passages to the waste mass may be used
.
Please be advised that according to Section 11
.6 (a,b,c) of the permit the use of ADCM
shall be subject to the following conditions

cover. I noted now that the waste was not exposed

We drove over to the working face which is in Phase IV
. They had both tippers working
. They
have a new compactor
. There were piles of processed landscape waste, wood chips and general
construction and demolition debris
. I discussed with Rob that the construction and demolition
debris may only be used for road building and not for alternate daily cover since it did not meet
the definition of clean construction and demolition debris sine it contained wood waste and
plastic.
We drove back to the scale house and I left at 12:30
