HEARING OFFICER ORDER

During the hearings that began on August 14, 2006, an oral motion was made to the

Board by representatives of Dynegy Midwest Generation, Inc

. and Midwest Generation L.L.C

.

The oral motion asked that the Board consider holding additional hearings and the potential for

moving certain provisions introduced in a joint statement to a subdocket

. After a discussion on

the record, a date of August 24, 2006, was set as a deadline for the filing of a written motion

. To

prevent undue delay, responses to the motion must be filed by August 31, 2006
