HEARING OFFICER ORDER

At the second hearing in this matter held June 29, 2006, the Illinois Environmental

Protection Agency (Agency) and NORA, the proponent of this rulemaking proposal, agreed to a

deadline of Wednesday, August 9, 2006 for the filing of post-hearing comments .

On August 7, 2006, the Agency filed a motion for extension of time in which to file

comments . In an order dated August 7, 2006, the hearing officer granted that motion and

extended the deadline for filing post-hearing comments to Wednesday, August 16, 2006 .

On August 11, 2006, counsel for NORA orally sought to extend by one or two weeks the

August 16, 2006 deadline for filing post-hearing comments

. Counsel for NORA has stated that

counsel for the Agency does not oppose an extension of that duration . The hearing officer has

contacted counsel for the Agency, who agrees that the Agency does not oppose such an

extension.

NORA's oral motion to extend the deadline for the filing of post-hearing comments is

granted. Whether from the Agency, NORA, or any other participant in this proceeding, those

post-hearing comments are now due Friday, September 1, 2006

. The "mailbox rule" at 35 Ill .

Adm. Code 101 .300(b)(2) does not apply to the filing of these post-hearing comments, and the

Clerk must receive these documents on or before the close of business on September 1, 2006

.
