HEARING REPORT
On August 9, 2006, a hearing in this matter was held at City Hall in Bloomington,
McLean County. Attorney Charles Northrup appeared on behalf of the petitioner. Attorney Joey
Logan-Wilkey appeared on behalf of the Illinois Environmental Protection Agency. No one
appeared on behalf of the Village of Saybrook.
Witness Credibility
One witness testified during the hearing:
Mr. Jerry Wilson
Based upon my legal judgment, experience, and observations at hearing, I find that the
credibility of witness is not an issue in this matter.
Exhibits
The petitioner offered seven exhibits as evidence at hearing. Exhibits A and B are site
maps; exhibits C, D, and E are groundwater sample results; exhibit F is the Material Safety Data
Sheet; and exhibit G is the water survey. There was no objection to any of the exhibits, and all
were admitted into the record.
Briefing Schedule
The transcript is due by August 21, 2006. Petitioner will file its brief by
September 21, 2006. Respondent’s brief is due by October 20, 2006. Petitioner’s reply, if any,
is due by October 27, 2006. The mailbox rule will apply.
