MOTION FOR EXTENSION OF TIME
IN WHICH TO FILE COMMENTS
NOW COMES the Illinois Environmental Protection Agency ("Illinois EPA"), by and
through one of its attorneys, Stephanie Flowers, and pursuant to 35
Ill. Adm. Code 101.522,
requests that the Hearing Officer for the Illinois Pollution Control Board ("Board") grant the
Illinois EPA a one week extension, until August 16, 2006, in which to file its post-hearing
comments in the above-captioned matter. In support of its motion, the Illinois EPA states the
following:
1.
That on July 18,2006, the Hearing Officer for this rulemaking issued an
order stating that during the June 29,2006 hearing the parties to this
rulemaking, including the Illinois EPA, agreed to a deadline of August 9,
2006 for the filing of post-hearing comments and that the Clerk must
receive the comments before the close of business on August 9,2006.
That the Illinois EPA had agreed to the August 9,2006 deadline under the
presumption that the transcript would be available by July,
loth,
2006,
which would allow sufficient time for review of the outstanding issues in

this matter but the transcript did not became available for review until July
14Ih,
2006.
That because of the delay in receiving the transcript coupled with the
conflicting schedules of the legal and technical staff of the Illinois EPA
regarding time off and vacation time, there has been insufficient time to
both review the transcript and develop adequate post-hearing comments
regarding the outstanding issues in this matter by August 9,2006.
WHEREFORE, the Illinois EPA respectfully requests that the Hearing Officer in this
rulemaking grant this motion and agree to allow the Illinois EPA a one week extension,
until August 16, 2006, in which to file its post-hearing comments.
