HEARING OFFICER ORDER
At the second hearing in this matter held June 29, 2006, the Illinois Environmental
Protection Agency (Agency) and NORA, the proponent of this rulemaking proposal, agreed to a
deadline of Wednesday, August 9, 2006 for the filing of post-hearing comments .
On August 7, 2006, the Agency filed a motion for extension of time in which to file
comments (Mot.). The Agency noted that the transcript of the second hearing did not become
available for review until Friday, July 14, 2006 . Mot. at 1-2 . The Agency further noted that
conflicting staff schedules have not provided it with sufficient time to draft post-hearing
comments. Mot. at 2 . Specifically, the Agency requests that the deadline for filing those
comments be extended by one week to Wednesday, August 16, 2006 .
Id. Counsel for NORA
has indicated to the hearing officer that counsel does not object to a reasonable extension of this
filing deadline .
The Agency's motion to extend the deadline for the filing of post-hearing comments is
granted
. From the Agency, NORA, or any other participant in this proceeding, those post-
hearing comments are now due Wednesday, August 16, 2006 . The "mailbox rule" at 35 Ill .
Adm. Code 10 1 .300(b)(2) does not apply to the filing of these post-hearing comments, and the
Clerk must receive these documents on or before the close of business on August 16, 2006.
